Consensual divorce cases

Custody and change of custody

Custody cases and divorce processes within Manavgat judicial boundaries are heard before Manavgat Family Courts under geographical jurisdiction rules.

As there is no independent family court in Gazipaşa district, consensual and contested divorce cases are decided by Gazipaşa Civil Court of First Instance sitting as a family court.

What are the legal requirements for a consensual divorce?
Under TMK Article 166/3, the marriage union must have lasted at least one year from the official wedding date for the case to be decided within a consensual divorce protocol. A protocol on the financial consequences of divorce and, if any, custody of joint children must be submitted to the court, and spouses must declare their will before the judge in person on the hearing date.
What is the court's primary criterion in custody cases?
Legal criteria in custody and change of custody cases are based on the principle of the best interests of the child. The court considers which parent can better meet the child's education, care and housing needs.
How long does a contested divorce take?
There is no fixed statutory duration for divorce cases. In contested cases, duration varies according to the nature of claims, hearing of witnesses, pedagogical examinations, property liquidation calculations and the workload of judicial authorities. Promising judicial outcomes in advance is prohibited.
