Criminal Law
Legal representation and counsel during investigation and prosecution stages.
Summary about Criminal Law
Criminal procedure law aims to establish the material truth through lawful means while safeguarding the constitutional rights of persons under suspicion of crime. At Büyük Law Office, we follow our clients' legal position within the limits prescribed by law from the investigation stage through prosecution, appeal and cassation, under the Turkish Code of Criminal Procedure (Law No. 5271) and the Turkish Penal Code (Law No. 5237). The duration and outcome of each file varies according to the nature of the offence, the state of evidence and the stage of proceedings; under judicial independence, no definite outcome can be promised.

Criminal cases within the judicial jurisdiction of Alanya and Antalya
In criminal proceedings, the competent court is determined as a general rule by the place where the offence was committed. Investigation and prosecution processes in districts around Antalya are subject to rules on judicial jurisdiction.
Although an investigation in Gazipaşa may be conducted by local authorities, Heavy Penal Court trials fall within the jurisdiction of Alanya Heavy Penal Court. Processes concerning Assize Court decisions in Akseki or Gündoğmuş are evaluated within the judicial district of Manavgat Heavy Penal Court. Under HSK regulation, Serik district is an independent Heavy Penal judicial district within its boundaries. Appeal reviews are conducted by the criminal chambers of Antalya Regional Court of Justice.
Büyük Law Office provides legal support at courthouses in Alanya, Manavgat, Gazipaşa, Serik and Antalya centre in compliance with regional jurisdiction and procedural rules.
Frequently asked questions
How long does a criminal case take?
The duration of criminal proceedings varies greatly depending on the type of offence, the scope of the file, and witness and expert procedures. Some cases before Assize Courts or under simplified procedure may be concluded more quickly, while multi-defendant or complex heavy penal files may last for years. The duration and outcome of judicial decisions cannot be promised in advance under judicial independence.
When can detention or custody be challenged?
Custody decisions, extensions of custody or arrest may be challenged immediately before the Criminal Peace Judgeship. Against detention decisions, an objection must be filed with the competent authority within the statutory period from learning of the decision (pronouncement or service).
Should I seek legal assistance when summoned for a statement?
Under Article 147 of the CCP, a suspect has the right to benefit from the legal assistance of a defence counsel of their choice at every stage of the investigation. Seeking legal support during the taking of a statement is a fundamental right conferred by law for the effective exercise of statutory rights (right to remain silent, right to request collection of exculpatory evidence, etc.).
